Sharing Of Porn Clip: Internet Users Face Up To 5 Years In Prison

A video featuring a teenager in full frolic with her boyfriend was leaked on Facebook on Tuesday October 4 2016. The video visible on the social network has since been removed, but the shares via private message multiplied. But do people know what they are exposed to from sharing such files?
According to Article 46 of the Information and Communication Technologies Act, anyone who has used a communication device or social networks to transmit or receive a message to indecent or obscene faces up to five years in prison and a fine not exceeding Rs 1 million. The viewing of such a file is also punishable by law.

A member of the legal profession explains that this type of offence to the law is brought directly to the intermediate court. This implies a large fine, which may be accompanied by a prison sentence depending on the magistrate.
Even if the user is the one who received the pornographic video, he exposes itself to a lawsuit if a complaint is filed against him. Moreover, it is forbidden to have obscene clips on electronic devices.

The Police press service also took the opportunity to warn Mauritian users against this type of offense.
